The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

Candidates will be required to answer these questions as part of the qualification process. The NMC Order and Registration Rules require that a nurse or midwife must be of sufficient good health and good character, and that they are capable of safe and effective practice. In fitness to practise proceedings a registrant may face an allegation that their fitness to practise is impaired by reason of their physical or mental health.
In both instances the registrant may be invited to submit to medical examination by experts appointed by the council. Medical examiners are required from a range of clinical areas for example psychiatry, OH, substance misuse and general medicine. A medical examiner will provide a comprehensive written report and in some instances, may be required to attend a hearing to provide live evidence.
