      Basildon Borough Council invites applications from suitably qualified and experienced contractors to carry out enforcement action(s) on land within the borough of Basildon whether under section 178 of the Town and Country Planning Act 1990 or any other legal authority. Initial selection of candidates will be via a pre-qualification questionnaire where applicants will be expected to demonstrate their experience, financial and commercial standing and evidence of good quality management. This contract represents a high-profile issue within the borough. The successful bidder must demonstrate robust and sound health and safety practices, commitment to upholding the principles of equality and diversity legislation, and be sensitive and responsive to the needs of vulnerable people, including children, the elderly, and infirm. The contract is for a period of four years with potential for a single extension or multiple periods of extension not to exceed a total of twelve months. The value shown in this contract is an estimate only for the entire term of the contract, including any potential period or periods of extension. Due to the nature of the requirement, the level and value of work to be undertaken in any one year is neither known nor guaranteed.

         The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

   VI.3)Additional Information: In order to uphold the principles of an open, transparent, and proportionate competitive process and to achieve value for money, the Council has advertised this contract in the Official Journal of the European Union. The Council has opted to use a restricted procedure to guide its procurement process. However, the Council reminds contractors that this contract is for “Part B” services of Section 3 of the Public Contracts Regulations 2006 (as amended) and is not fully subject to the provisions of those regulations. The general format of the restricted procedure from the Regulations will be followed where the Council considers appropriate but the Council reserves the right to depart from that procedure at any time.

Although this tender is for Part B Services, in preparing for this tender the Council has considered the Public Services (Social Value) Act 2012.
