II.2.4) Description of the procurement: ForHousing is a Member of the Fusion21 (F21) Member’s Consortium. The contract, which has been awarded to Liberty, has been awarded under Lot 1 and Lot 6 of the F21 Heating, Renewables, and Electrical Framework (2024-28) (2023/S 000-028807). ForHousing has awarded a 10 year contract to Liberty for the provision of planned and reactive servicing, maintenance and testing of heating systems, and certain services and works relating to domestic and commercial plant and equipment. Liberty is the number 1 ranked contractor across Lot 1 and Lot 6 for the North West of England, and the contract has been awarded using the Direct Award with Negotiation procedure as set out in Schedule 13 of the Framework. The core pricing model within the framework is based on a schedule of rates and the call-off pricing has been established by applying quantities to the tendered rates. The ability to direct award under the framework agreement allows the contract to be procured in compliance with the framework terms.

2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union
The procurement falls outside the scope of application of the directive: Yes
3. Explanation
For Housing Limited was not required to publish a call for competition in the Find a Tender Service for the call-off contract on the basis that this contract has been awarded pursuant to the Fusion21 framework. ForHousing Limited and Fusion 21 are satisfied that the call-off contract has been awarded in compliance with the framework agreement and in accordance with its terms. As such, the call-off contract is permitted under the Public Contracts Regulations 2015 (the "PCR") and complies with the rules re. awarding contracts based on framework agreements as set out in regulation 33(8)(a) of the PCR. A Contract Notice (2023/S 000-028807) and corresponding Contract Award Notice (2024/S 000-003257) were published for the framework but the prior publication of a Contract Notice was not needed for this call-off.
