Justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

   The procurement falls outside the scope of application of the directive: Yes

3. Explanation

   Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
   lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
   Modification of the Contract has been made in accordance with Regulation 72(1)(c) of The Public Contracts Regulations (PCR) 2015.

The original contract notice was for 2 years + 2 x 12 months extensions (01/03/2019-01/03/23) and the estimated value was £8m based on £2m per annum

To date since the contract commenced CITB have only spent £4.5m. There was a significant underspend during the pandemic.
A large proportion of costs were related to:
a) the print and distribution of revision materials to support HS&E testing and test centres were closed during COVID.
b) printed material to support events (eg. career days, employer events) which did not go ahead during COVID.

CITB are looking to extend the current contract for a 12 month period until 29/02/2024.
CITB will undertake an open competitive tender exercise alongside this VEAT notice during 2023 (planned to commence June 2023).
