2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

3. Explanation

   Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
   lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
   The contract was awarded through a Framework Agreement and is due to end in Jan 2022. This Notice is to provide further information on a proposed 3 year, £6M extension, to ensure the Department's systems are compatible with the common UK digital platform, including ongoing maintenance of the motorway control system and provision of a new IP transmission network.

Technical difficulties, including exclusive rights (such as intellectual property rights) require the extension of the contract with CUBIC Transportation Systems Ltd.

This contract will be modified under the Public Contracts Regulations Clause 72(1)(b).
