The NDA is exploring options for the disposition of the UK civil plutonium stockpile using a variety of methods for re-use or disposal.

   Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
   lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
   This service is for the development of incorporation of Plutonium powders using Hot Isostatic Pressing (HIP) technology. The powders samples required for this testing are located at Sellafield Limited, and the NNL’s Central Laboratory facility on the site is the only location where appropriate samples can be obtained. NDA wish to engage NNL for research / experimental / procurement of equipment, installation and tests off-site, with the intention of installing and operating the service and equipment in the Central Laboratory under a future contract.

The powder samples required for the testing of the HIP equipment can only be obtained at the Central Lab at Sellafield, which is operated by NNL. The HIP equipment will be installed and operated by NNL in their Central Laboratory under a future contract.

NNL are the sole operators in the Central Lab and have the expertise to complete this requirement.
