1. Justification for the choice of the negotiated procedure without prior publication of a call for competition in accordance with Article 32 of Directive 2014/24/EU

3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
(ii) competition is absent for technical reasons: Energy and Utilities Skills are the standards setting authority for the gas industry, with the role and remit for developing the UK standards, under the licence granted to them as a Sector Skills Council by the government through the UK Commission for Employment and Skills (a non-departmental public body). Therefore EUS are the only body able to carry out this work due to their singular authority and official remit to set training standards for the gas industry.
(iii) the protection of exclusive rights, including intellectual property rights: EUS is the standards setting body for the gas industry with the remit of setting National Occupational Standards; therefore they have the IP bound up with the existing standards and any additions made to them for the use of hydrogen. Ultimately, looking to appoint any other organisation to perform this function would undermine the integrity of the standards.
As per the justifications given above, there are no reasonable alternative suppliers to EUS for the development of a hydrogen gas training standards framework, due to the impartial and final authority this body has been afforded under their remit to set National Occupational Standards under the licence granted to them through the UK Commission for Employment and Skills.
