3. Explanation

   Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
   lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
   The contract concerns the construction of apartments on a site which New Cross RE Limited (“NCRE”) has a contract to acquire and on which NCRE has secured planning consent. The London Borough of Lewisham wishes to purchase this site. The site is only available for sale to the London Borough of Lewisham on the condition that the development is constructed by NCRE’s appointed contractor, Charles Edward Limited. As the site may only be purchased as part of this development package, and would not otherwise be available for sale to the London Borough of Lewisham, the works may be provided only by a particular economic operator. Accordingly, the contracting authority (acting as agent for the London Borough of Lewisham) is permitted to award the contract without prior publication pursuant to regulation 32(2)(b) of the Public Contracts Regulations 2015. This site will assist the London Borough of Lewisham with achieving its target to deliver affordable housing in the borough for which it has funding.
