   3. Explanation
          Use of the negotiated procedure without prior publication (Regulation 32(2)(c) of The Public Contracts Regulations 2015).

In accordance with Regulation 32 (2)(c) of The Public Contracts Regulations 2015 the contracting authority has used the negotiated procedure without prior publication on the basis that for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with.

The contracting authority has been unable to directly employ suitably qualified and skilled labour into 18 roles within the Village Management Functional Area that are critical to the successful delivery of the Birmingham 2022 Commonwealth Games. Therefore, the appointment of a supplier who can provide the suitably skilled labour is now urgently required to allow the supplier enough time to begin mobilising the workforce and especially taking into consideration the challenging market conditions currently being experienced in the events industry around workforce shortages. The circumstances that have led to the use of a direct award without prior publication are not in any event attributable to the contracting authority, e.g., the contracting authority has not done anything to cause or contribute to the situation.
