3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
Within the last several months, a number of similar organisations to Sovini have experienced cyber-attacks. Through research, it has been identified that a cyber breach can present an approx. £2.75m cost to an organisation, a 5% loss in customer retention and an average of over 200 days to detect and respond to. Sovini's current risk of a cyber-attack is now indicated as a high risk scoring 16 (likelihood 4 x impact 4). Thus, cyber threat security is an urgent function for Sovini to implement the right solution for protection and risk mitigation.
From reviewing the market, Darktrace has created a self-learning artificial intelligence system for cyber defence, its functionality provides a unique cyber security solution. The sole source supplier: Darktrace are able to provide support to Sovini during the Christmas period shut down to minimise the cyber risk, through its unique capabilities such as learning techniques to create bespoke protection, total coverage for the entire digital estate, AI-driven investigations and rapid, on-demand triage of high-fidelity incident identification and 24/7 SOC.
Darktrace has offered Sovini a competitive offer that provides economic value to Sovini by entering into the agreement with the sole source provider. Given the market research has identified no other competitors can provide this solution, a tender would potentially result in delays to getting a solution in place, increasing the risk to Sovini and less of an economic advantageous price being received.
