ANNEX D

   2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

         The procurement falls outside the scope of application of the directive: Yes

   3. Explanation
          Due to failure inside one of the LPHW boilers (1 of 2) during a recent statutory inspection, the LPHW boiler must be shut-down until the necessary repairs can be procured and the work completed. We have managed to identify a contractor that can satisfy all of the relevant technical aspects of the project and deliver the project within the hire agreement of the temporary boiler.
As a consequence, we need to use Regulation 32(2)(c) of the Public Contract Regulations 2015 to undertake emergency procurement without competition to safeguard ARES operations at the earliest opportunity and potential catastrophic impact on animal research at the facility.
