ANNEX D

   2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

         The procurement falls outside the scope of application of the directive: Yes

   3. Explanation
          Due to failure inside one of the LPHW boilers (1 of 2) during a recent statutory inspection, the LPHW boiler must be shut-down until the necessary repairs can be procured and the work completed. During this period, the facility has an increased business continuity risk. As a consequence, we need to undertake emergency procurement without competition to safeguard Ares operations at the earliest opportunity and potential catastrophic impact on research at the facility.
