   II.2)Quantity Or Scope Of The Contract
      II.2.1)Total quantity or scope:
      The services will be required from April 2013 to December 2016 pursuant to a consultancy appointment. The appointment may be extended beyond this period if required. It is likely that the majority of the work will be completed by the beginning of the construction period, currently estimated to be December 2014.

These services do not include traditional quantity surveying services; as such services will be procured through a separate arrangement.

The financial/commercial advisors will be responsible for the production of the Outline Business Case for the project. The key types of advice required for the business case and the project in general are listed below (this list is not exhaustive);

·   Arena business plans and operating models
·   Arena commercial issues such as naming rights, merchandising etc.
·   VAT, Insurance and tax issues
·   Trends and themes in the leisure industry
·   Size and Configuration of Arena
·   Procurement route for the construction and operations
·   Soft Market Testing
·   Advise the Council on commercial matters related to the project
·   Assist in the evaluation of Operators proposals
·   Financial and Commercial advice on the “deal” structure for the project, to include debt financing and financial modelling.
·   Advice on commercial operating structures e.g. arms-length or operator
·   Exploring other opportunities for the site e.g. conference and exhibition facilities
·   Contribute to the strategic vision for the city in terms of its cultural and events strategy
·   Assist in assessing the economic benefits the project will bring.
·   Advising whether the Arena will produce sufficient income to meet the prudential borrowing costs and other costs the Council will need to meet to ensure the Arena is viable in the short term (build and initial opening) medium term (prudential borrowing) and long term


When the scheme is sufficiently developed the Council will then seek to procure an Operator for the facility. The financial/commercial advisors will also assist the Council in,

·   Assist in the negotiation process with operators
·   Production of an operator selection report


The financial/commercial advisors will also be responsible for the production of the Final Business Case and the development of a financial model.

In awarding this contract, the Council is not bound by the formal procedures in the Public Contracts Regulations 2006 (as amended) as the contract value is below the relevant threshold, and so reserves the right to deviate from the formal procedures in the Public Contracts Regulations 2006 (as amended). The procedure for awarding the contract is set out in the Invitation to Tender.
