3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The Kainos Evolve electronic document management system with scanning solution has been embedded for a number of years at the Trust.
There is a need for continuing maintenance and support of the Kainos system while the on-going requirement is reviewed following the implementation of an electronic patient record (EPR). The EPR is fully implemented now and it is apparent that the functionality required from the document management system has now changed. Work is on-going to appraise the Trust's options which include taking up a module which exists within the EPR system or going out to a full procurement for a new solution. The appraisal is complex and links in with the Trust's digital transformation plan and requirement to "Go digital" in line with NHS IE policy.
The Trust understands that it is unlikely that an alternative supplier would be able to access the Kainos software to provide support during the 2 year contract term which is required to appraise, implement and embed a new solution. To attempt to procure a short term solution at this point in the appraisal process would require substantial duplication of costs and resource and a hasty implementation would put patient safety and service provision at risk.
