    WFCCG are to contract with (Provider Name) for the provision of (Number of Beds) Care Home Services at Bisterne Avenue, Walthamstow. A procurement process has not been followed as WFCCG believes that there are no alternative providers within the market who have the required bed capacity that WFCCG intends to commission to meet the current demands. Given the time it would take to bring new capacity to the market through new builds or conversion of existing sites, which would both have to go through protracted planning applications, with no guarantee of success, WFCCG believes that additional beds can only be provided by (Provider Name) and intends to make a direct award of a contract to them.

2. Other justification for the award of the contract without prior publication of a call for competition in the Official Journal of the European Union

3. Explanation

   Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
   lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
   Waltham Forest Clinical Commissioning Group (WFCCG) have been considering options to address a capacity deficit of affordable nursing home beds within the borough. Market research was undertaken and commissioners identified a vacant and non-operational nursing home on Bisterne Avenue, Walthamstow and WFCCG now intends to commission nursing home beds from this site. London Borough of Waltham Forest’s Planning Register has reviewed the local market and can evidence that there are no other premises of sufficient quality standard and with the requisite CQC registration are currently available in the borough.

The alternative options of providing the nursing home services required by WFCCG is by commissioning new builds or converting existing sites into nursing homes. Both of these options will be subject to securing planning permission for a new build or change of use application for the conversion of existing sites. Both of these options would take several years to achieve and do not meet WFCCG’s need to commissioning additional nursing bed capacity now, to address the constraints which impacts patient care.

Due to these factors, WFCCG does not believe that there are providers in the market, who are able to provide the additional nursing home bed capacity that it requires within the boundary of Waltham Forest CCG area.
