3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The appointment of EST is to provide an advisory service is made under Regulation 32 (2) (b) (ii) and (9) of the UK’s Public Contracts Regulations 2015 (negotiated procedure without notice). Government analysis has shown that consumer advice is on-going requirement which needs to continue whilst a digital solution is developed through the Government Digital Service, with the likely commencement in April 2018. It would be a major inconvenience to BEIS to retender this for a relatively short contract when a new company would be required to have a working knowledge of energy efficiency to deliver this service and that the bidder would incur additional start-up costs in getting the service and call agents up to speed and fully trained.
The EST contract will commence on 1st October and ending on 31st March, an option to extend for up to a further 3 months is included should delays arise due to the testing of the digital platform. The value of this contract will be £1,384,407 (GBP). The plan is to compete the new requirement after the digital testing, through the Government's frameworks via Crown Commercial Services.
